An Act to provide for Parliamentary Elections to be held under the Alternative Vote System, to make provision for the Dissolution of Parliament, to make provision for the Number and Size of Parliamentary Electoral Constituencies, and for connected purposes

Be it Enacted by His Most Gracious and Excellent Majesty, by and with the Advice and Consent of Parliament assembled, as follows–

  1. This Act will be known as the Parliamentary Voting System and Constituencies Act, Bill 9163, 2026.

Parliamentary Voting System

  1. On the day of a designated general election, electors will be given access to a digital ballot which will be open from Midnight on the designated day of the general election for Twenty-Four (24) hours where all the candidates within the elector’s specific riding will be displayed. The elector will have the discretion of which candidates to rank, which not to rank (if any) and the order in which each candidate is ranked. As a part of universal early-voting, electors will be given access to the ballot for an additional Twenty-Four (24) hours previous to the official opening of the ballot on the designated day of the general election.
  2. The Election Commission will select volunteers to count ballots cast.
  3. Should there be only a single candidate within a riding, no ballot will be issued and the candidate will automatically be deemed to be duly elected as a Member of Parliament for that riding on election night.
  4. Upon the counting of ballots should a candidate receive a majority of the votes cast, that candidate shall be deemed to be duly elected as that Member of Parliament for that riding.
  5. Should no candidate receive a majority of votes cast, then the candidate who has received the least amount of votes cast will be eliminated and the votes for the eliminated candidates will be re-counted, with the elector’s next preference (should they not already be eliminated) counted, unless there is no suitable preference to count in which case the ballot will be deemed to be exhausted and not counted.
  6. The process of elimination and re-counting shall continue until a candidate is elected with a majority of the vote.
  7. In cases of an absolute tie in a riding, the Chief Election Commissioner will break the tie.

Dissolution of Parliament

  1. Unless dissolved earlier in accordance with Section 16 of the Parliamentary Reform Act, 2024, a Parliament shall automatically be dissolved on the fourteenth working day following the first anniversary of its first meeting. The designated day of the general election occurs no earlier than Seven (7) working days following the dissolution of Parliament and no later than Twenty-One (21) working days following the dissolution of Parliament.

Ridings

  1. Each riding will elect no more than one (1) Member of Parliament.
  2. The number of ridings in Baustralia will be ten (10).
  3. The Secretary of State will, upon the entry of this Act into law, order the Election Commission to open an electoral registry.
  4. The electoral registry shall ask for the following details of citizens:
    1. Name.
    2. Assigned county of origin.
  5. No person shall be eligible to be an elector for the purposes of any Baustralian election if they have not registered on the electoral registry.
  6. After a period of three months following the opening of the electoral registry, the Election Commission shall organise electors into ridings (hereinafter called the boundary review) and will within a month present to the Secretary of State the boundary review who will then present to the Parliament a bill which will enact the boundary review into law.
  7. The formula for determining the size of ridings will generally be: No. of Electors divided by 10. The Election Commission will determine reasonable adjustments to ensure fairness in the size of ridings.
  8. No riding will comprise electors from more than one county, unless the riding comprises the entire electorate of two or more counties exclusively.

General Elections and By-Elections held prior to Completion and Enactment of Boundary Review

  1. Should the present Parliament be dissolved prior to the completion and enactment of the Election Commission, the subsequent parliamentary general election will be conducted with each county electing two Members of Parliament.
  2. If a parliamentary general election is held under these circumstances, or should during the course of the current Parliament, a parliamentary by-election is held for multiple Members of Parliament in the same riding, votes will be counted until there are two non-eliminated candidates, or in the case of a by-election to elect three Members of Parliament within the same riding, three non-eliminated candidates.
  3. Section 14 of this present Act shall not apply to a parliamentary general election or parliamentary by-election held prior to the completion and enactment of the boundary review.
