An Act to Establish Provisions Regarding Citizenship in Baustralia and Purposes Connected Therewith

Terms

  1. This Act shall be known as the Citizenship Act, 2024, Bill C7131.
  2. Any person born within the jurisdictions of the Kingdom of Baustralia after the commencement of this Act will be known as as a Citizen of Baustralia, with the expression, “Baustralian Subject”, or the terms “citizenship” and “nationality” being synonymous and without any difference in this Act, unless provided for otherwise.
  3. A person will not be a Baustralian Citizen by virtue of this Section at the time of their birth if-
    1. at least one of their parents possessed diplomatic immunity or immunity from suit and legal processes as is accorded to an envoy or ambassador of a foreign head of state accredited to the Kingdom of Baustralia already; or
    2. at least one of their parents are enemy aliens and their birth occurs in a place then under occupation by the enemy, to which their parents belong by virtue of citizenship or nationality.
  4. The term “alien” in this Act refers to any person who is not a Baustralian Citizen, unless provided for otherwise.
  5. Any person being the age of fourteen and of sound mind and body, will be entitled, upon making an application to the relevant government ministry tasked with home affairs, in the prescribed manner, to be registered as a Baustralian Citizen, if they satisfy the relevant government ministry tasked with home affairs that-
    1. they are ordinarily resident in the Kingdom of Baustralia or its jurisdictions and have been so resident throughout that period for at least a month, or such shorter time as the head of the relevant government ministry tasked with home affairs so judged; or
    2. they are approved at the discretion by the head of the relevant government ministry tasked with home affairs.
  6. Any person, who is legally married to a Baustralian Citizen, by law within or outside of the Kingdom of Baustralia and its jurisdictions, will be entitled, upon making an application thereof to the relevant government ministry tasked with home affairs, to be registered as such, if they are of the age of fourteen and are of sound mind and body.
  7. The head of the relevant government ministry tasked with home affairs may cause a minor, being a person under the age of fourteen, to be registered as a Baustralian Citizen, upon application being made thereof on their behalf by an individual of at least eighteen years of age, or the head of the relevant government ministry tasked with home affairs may do so at their own discretion.
  8. Any person who is ordinarily considered a Baustralian Citizen prior to the commencement of this Act will have their citizenship status duly registered and recorded by the relevant government ministry tasked with home affairs.
  9. Any person may, at any time, renounce their citizenship, by undertaking a written application to the relevant government ministry tasked with home affairs, and the aforesaid application being countersigned by the head of the relevant government ministry tasked with home affairs, and for such an action to be made public in an official gazette or notification.
  10. Any person may be deprived of their citizenship by the reigning monarch at their discretion, or by being induced to do so by at least two cabinet ministers.
  11. Notwithstanding Section 11 of this Act, the head of the relevant government ministry tasked with home affairs can deprive any person of their citizenship if they are found to be-
    1. engaged in a war, conflict or skirmish; or unlawfully traded, communicated, engaged or associated with the enemies of the Kingdom of Baustralia against the state or the Crown; or
    2. have displayed a tendency, physical or verbal, to subvert the general peace and tranquility of the Kingdom of Baustralia and its citizenry.
  12. The relevant government ministry tasked with home affairs may make provision for carrying into effect the purposes of this Act, including-
    1. the regulation of anything required or authorized under this Act; or
    2. the administration or taking of oaths of allegiance or affirmation; or
    3. the provisions for a certification of citizenship or deprivation thereof; and
    4. any other matter related thereto or as authorized by this Act.
